Users Rights
Basic Rights
The Charter of Rights and Freedoms and the Québec Civil Code do state the person's basic rights:
- right to life and integrity of person;
- right to the preservation of one's dignity;
- right to privacy;
- right to the respect of one's reputation and name;
- right to professional confidentiality;
- right to inviolability;
- right to autonomy and self determination;
- right to equality.
Guidelines
Section 3 of the Health and Social Services Act states five guidelines that should govern health and social services's management and provision:
- the raison d'être for service delivery is the person that needs them;
- respect of the users and recognition of their rights and liberties must inspire the actions toward them;
- in all interventions, the user must be treated with courtesy, equity and understanding, in full respect of his dignity, autonomy, needs and safety;
- the user should, inasmuch as possible, participate to the cares and services that affect him;
- the user, through adequate information, should be encouraged to use services in a sound manner.
Users Rights
Sections 4 to 28 and sections 34 and following, of the Act pertaining to users rights:
- right to information;
- right to services;
- right of professional or of institution choice;
- right to receive cares required by one's health situation;
- right to accept or refuse health cares;
- right to be part of the decision process;
- right to be attended to, assisted and represented;
- right to be sheltered;
- right to receive services in English;
- right of access to one's own health record;
- right to the confidentialality of one's user file;
- right to lodge a complaint.
